INDIANA NEW HOME WARRANTY ACT
WHAT YOU NEED TO KNOW!
The Indiana New Home Warranty Act (Indiana Code 32-27-2) is very specific about what a builder must do to waive implied warranties on a new home purchase. Within this code, the following warranty must be provided to waive implied warranties:
1. During the TWO YEAR period beginning on the Warranty Date, the home will be free from defects caused by faulty workmanship or defective materials.
2. During the TWO YEAR period beginning on the Warranty Date, the home will be free from defects caused by faulty installation of plumbing, electrical, heating, cooling, all ventilating systems, exclusive of fixtures, appliances, or other items of equipment.
3. During the FOUR YEAR period beginning on the Warranty Date, the home will be free from defects caused by faulty workmanship or defective materials in the roof or roof systems of the home.
4. During the TEN YEAR period beginning on the Warranty Date, the home will be free from major structural defects.
At HBM, we provide our customers the warranty explicitly called out by the Indiana New Home Warranty Act. Furthermore, we contractually require every subcontractor we use to honor this same warranty to perform work on our projects. This means, as a customer, you are getting the warranty explicitly called out on your behalf as part of your new home purchase both from HBM and the subcontractors we utilize during construction.
Unfortunately, there are countless custom home builders offering ONE YEAR warranties and only requiring ONE YEAR warranties from their subcontractors to save money and still claiming to waive "implied warranties" in their construction agreements. This is simply 100% against Indiana code and not something, as a customer, you should accept. It is so common in Indiana to violate this Indiana code, it has practically become "common practice" in our industry.
